Did You Know: Superannuation funds are slow to release funds?

2021-09-17T12:24:11+10:00August 31st, 2021|

When there has been a death of a member of a superannuation fund, there are often delays in having the funds released to the family. Unfortunately, there are often cases where there is a widow in urgent need of funds but the superannuation fund takes around a year to make the payment. Our best advice to speed-up the process, is that you execute a binding death benefit nomination as part of your estate planning. This means, contacting your particular fund and asking them to provide you with the appropriate form, executing it properly in the presence of two witnesses who are not beneficiaries and returning it [...]

2021-09-17T12:23:49+10:00August 31st, 2021|

When you make a verbal agreement with a family member, is the agreement binding? Verbal agreements come in all shapes and sizes ranging from “I will mow the lawn if you wash the car”, or “I will give you pocket money if you do your chores”; to the more complex agreements like “I will pay for the plane tickets, but you need to pay me back”, or “I will give you the deposit to buy a house, but the money will be taken out of your inheritance”. Verbal agreements can be enforceable under contract law. To be binding, a verbal agreement has to have the following [...]

Did You Know: That Courts don’t like Ouija boards?

2021-09-17T12:23:05+10:00August 31st, 2021|

In 1994, Stephen Young was being tried for the brutal murder of Harry and Nicola Fuller. The night before the verdict was to be given, four members of the jury made a make-shift Ouija board out of a sheet of paper and wine glass. They made contact with Harry’s spirit and asked who’d killed him. The wine glass began to move slowly to “Stephen Young done it”. One jury member, who was aware of this séance but did not participate, reported it to the Court. Concerned with the prejudicial effect that the jurors’ actions may have had on the verdict, a retrial was ordered. Stephen Young [...]

Did you know Ticli Blaxland recently celebrated its 80th anniversary?

2020-12-01T13:23:30+10:00December 1st, 2020|

It was a simpler time. Men’s trousers sat exceptionally high, about 3 inches above their belly buttons. Their ties were only around 6 inches long and just as wide. Smoking was still cool and Fedoras, mandatory. Don Bradman was the biggest name in sport and the latest technical advancement was the refrigerator. It was in this era that Ticli Blaxland was born. Founded by sole practitioner John Eyles on 15 November 1940, it was the first law practice established in the small fishing and banana growing town, existing today. Forged by the flames and steeled by the floods that ravaged the town that year, John [...]

Did you know that workers can claim workers compensation for contracting COVID-19?

2020-11-19T15:40:35+10:00October 29th, 2020|

The Workers Compensation Act was recently amended by the Covid-19 Legislation Amendment [Emergency Measures – Miscellaneous] Bill 2020 (NSW), allowing workers in certain industries to gain easier access to workers compensation benefits if they contract COVID-19 in the course of their employment. Prior to the changes, workers who contracted COVID-19 had to prove that it was causally related to their workplace and that employment was a substantial contributing factor to the disease. This proved difficult given the scope of potential sources of infection outside of the workplace environment. The law now provides that if a worker in prescribed employment contracts COVID-19, there is a presumption that [...]

Did you know how to address employee poor performance?

2020-11-19T16:04:20+10:00October 29th, 2020|

There are two main reasons employers seek our advice about existing employees. The first is that an employee has engaged in some form of misconduct, the other is that an employee is underperforming. Both issues should be approached very differently. In cases of misconduct, employers should seek the advice of a lawyer before taking any action, particularly in cases of serious misconduct. However, when addressing underperformance, employers should follow these simple steps to ensure they comply with their legal obligations: 1. Identify the issue Is the employee not meeting targets? Are they not performing in line with other employees?  It is important to identify the problem [...]

Why did you choose law? The legal system underpins all aspects of society. Unfortunately, it’s a system that many individuals find themselves having to navigate alone in times [...]

Did you know that Rent Relief for Commercial and Retail tenants will continue until at least 24 April 2021?

2020-09-30T16:17:52+10:00September 30th, 2020|

COVID-19 has had a dramatic effect on businesses, particularly in the Retail Industry. In an attempt to mitigate these effects, the NSW government introduced National Cabinet Mandatory Code of Conduct (Code) and the Retail and Other Commercial Leases (COVID-19) Regulation 2020 (Regulation). A recent decision of the Supreme Court of NSW gives landlords and tenants some guidance on how to apply the Code and the Regulations. The Code and Regulations require landlords and tenants to negotiate, in good faith, reductions in rent during the pandemic period. Reduced rents negotiated under the Code must continue for a “reasonable recovery period” after the end of the COVID pandemic. [...]
