Hypothetical by Manny Wood published in the Coffs Coast News Of The Area on 19 December 2020.
It was two days before Christmas and Santa’s workshop had never been busier. Toy production had been on hold due to the Coronavirus pandemic, which left the elves frantically trying to meet their yearly toy quota. The workshop was a mess, with tools and toy parts scattered all over the floor.
Peewee, the Chief of elf staff, was walking towards the wooden toys department when he tripped on a set of plyers. He was unable to regain his balance and crashed face-first into a pile of Jenga blocks.
Peewee suffered a devastating blow to his neck and was immediately conveyed to the North Pole Hospital. As a result of the incident, Peewee required immediate surgery and was likely to remain off work for at least a year. His Specialist, Dr Rudolph, advised he would need weekly physiotherapy and likely be on pain medication for several years.
Concerned about his rights, Peewee sought advice from a Solicitor at Elvish Folk & Co. The Solicitor informed him that he was entitled to lodge a workers compensation claim with Santa’s workers compensation insurer. The insurer would pay him a portion of his pre-injury wages and any reasonable and necessary treatment associated with his injuries. Once his injuries stabilised, he could also potentially make a claim for lump sum compensation.
Peewee was delighted to hear this and lodged the claim the following day. Santa was very understanding and reassured Peewee that his role would remain open until he returned to the workshop. Peewee was relieved and grateful to his Solicitor for the advice. Now that he was aware of his entitlements, he was able to focus on treatment without worrying about the financial cost.
